Terms of Service

1. Acceptance of Terms

Welcome to Circles ("FavCircles," "we," "our," or "us"). By creating an account or using our mobile application, website, or connected services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of the Service

Circles is a private social recommendation platform that lets you save favorite places, organize them into collections ("circles"), share them with people you know, and discover places recommended by your trusted network. The Service also lets you create digital postcards and, for a fee, have a printed postcard mailed on your behalf (see Section 9).

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that any registration information you provide is accurate.

4. Your Account

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to notify us promptly of any unauthorized use of your account.
• You may delete your account at any time from within the app or via our data deletion page.

5. Your Content

You retain ownership of the content you create on the Service — your circles, saved places, notes, photos, videos, and comments ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content solely as needed to operate and improve the Service, consistent with the privacy level you choose (public, my network, or private).

You are solely responsible for your User Content and represent that you have the rights necessary to share it.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Post content that is abusive, harassing, defamatory, obscene, or infringes others' rights
• Impersonate any person or misrepresent your affiliation with anyone
• Attempt to gain unauthorized access to other accounts or our systems
• Scrape, harvest, or collect user data without permission
• Interfere with or disrupt the operation of the Service

We may remove content or suspend accounts that violate these rules.

We have zero tolerance for objectionable content and abusive users. Every piece of user-generated content in the app can be reported, and any user can be blocked. Reported content is reviewed promptly — typically within 24 hours — and offending content will be removed and the responsible accounts suspended or permanently banned.

7. Connected AI Assistants

You may connect your FavCircles account to third-party AI assistants (such as ChatGPT or Claude) through our secure authorization flow. When you do:

• The assistant can access and act on your FavCircles data (your profile, circles, places, and your network's shared recommendations) on your behalf, subject to the same privacy rules that apply in the app.
• You can revoke this access at any time from the assistant's settings.
• Your use of the third-party assistant is governed by that provider's own terms and privacy policy; we are not responsible for how the provider processes your data outside our Service.

8. Subscriptions and Purchases

Some features of the Service require a paid subscription, purchased through the Apple App Store. Billing, renewal, and cancellation are handled by Apple under its terms. Except where required by law, subscription purchases are non-refundable.

Printed postcards are a physical product rather than a digital one, so they are not sold through the App Store. They are paid for by card using Apple Pay, processed by our payment processor, Stripe. Section 9 sets out how that works.

9. Printed Postcards

You can ask us to print a postcard you have designed in the app and mail it to a postal address you provide. The following terms apply to that service.

• What you get. One 4x6 inch postcard, printed and mailed by our print-and-mail provider and delivered by the United States Postal Service as First Class mail. United States addresses only.
• Price. The price is shown in the app before you pay, and you are charged nothing beyond it. We do not currently collect sales tax on these orders.
• When you are charged. Paying places a hold on your card. The hold is only converted into a charge when your postcard is sent to the printer, roughly an hour after you place the order.
• Free cancellation. You can cancel from the app at any point before your card goes to print, and you will not be charged at all. After it has gone to print, the order cannot be canceled or changed.
• If we cannot print it. If your postcard cannot be printed or mailed, you are not charged. If the charge has already been taken by that point, we refund it in full.
• Addresses are your responsibility. We check the address against postal records and show you the corrected version before you pay, but we cannot detect an address that is valid yet simply wrong. Printed postcards carry no return address, so a card that cannot be delivered is discarded by the postal service rather than returned to you, and cannot be refunded once mailed.
• Delivery times are estimates. Any arrival date we show is the postal service's estimate, not a guarantee. We are not responsible for mail that is delayed, damaged, or lost in transit.
• What you may print. You must own or have permission to use every photo and any other content you put on a postcard, and it must not be unlawful, abusive, hateful, obscene, or infringing. We and our print provider may refuse to print anything that breaks these rules, in which case you are not charged.
• Third parties. Printing and mailing are performed by our print provider, and payments are processed by Stripe. We share only the information needed to produce and deliver your postcard and to take payment.

10. Intellectual Property

The Service — including its design, software, logos, and branding — is owned by FavCircles and protected by intellectual property laws. Except for your User Content, nothing in these Terms grants you any right to use our intellectual property without prior written consent.

11. Third-Party Content and Services

The Service may display information from third-party sources (such as maps and place data) and link to third-party websites. We do not endorse and are not responsible for third-party content, products, or services.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Recommendations on the Service reflect the opinions of the users who shared them; we make no guarantee about the quality, safety, or availability of any place or business listed.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAVCIRCLES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify and hold harmless FavCircles from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms.

15. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or where required by law. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including Sections 9, 11, 12, and 13) will survive.

16. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and, for material changes, notify you through the app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in New York, New York.
